Members of the Trump regime, including Marco Rubio, spent the weekend publicly complaining about Judge Boasberg, saying that the Government had the right to disregard the court order, and asserting sweeping, far-fetched claims about Trump’s unilateral powers to remove immigrants from the country on the grounds of national security. The DoJ appealed the TRO on 3/15 and is specifically seeking Boasberg’s removal from the case. 6/

Right now, as I’m writing and posting this thread, there is a hearing in the case, conducted by Boasberg, who is trying to ascertain whether the Government ignored/contravened his TRO, either by refusing to turn back flights already en route or allowing a third flight to take off. 7/

The hearing just ended. The Government took some breathtaking positions. They basically refused to give the judge any information about the flights or the people on them, saying that they didn’t have to because the President’s broad national powers means they don’t have to tell the Court anything. There is NO legal basis for this claim. 8/

There are laws specifying that the Govt must tell the judge specific bases for withholding classified information from the court; DoJ lawyer for the Govt refuses to do this. (Note there are procedures for disclosing classified information without putting content into public record - Boasberg not suggesting the government has to declassify information.) 9/
